13.16.240 Violation--Penalty.

A. Whenever the city finds that any user has violated or is violating this chapter, their wastewater contribution contract, or any prohibition, limitation of requirements contained herein, the director of public utilities may serve upon such a person a written notice stating the nature of the violation. Within thirty (30) days of the date of the notice, a plan for the satisfactory correction thereof shall be submitted to the director of public utilities.

B. Any user who shall continue any violation beyond the time limit provided for in subsection (A) of this section shall be guilty of a misdemeanor, and on conviction thereof shall be fined in the amount not exceeding one hundred dollars ($100.00) for each violation or jail sentence not exceeding thirty (30) days, or both such fine and incarceration. If the conviction is for a violation committed after a first conviction, punishment shall be a fine not exceeding three hundred dollars ($300.00) per day of such violation, together with imprisonment of not more than ninety (90) days as may be assessed by the court for each day of violation. Each twenty-four-hour period in which any such violation shall continue shall be deemed a separate offense.

C. Any person violating any provisions of this chapter shall become liable to the city for any expense, loss or damage occasioned the city by reason of such violation. (Prior code § 9-319)
