13.28.100 Reopening grave for disinterment--Permits.

Fees for permits for reopening graves and disinterment for the city shall be as follows:

A. Any person desiring to reopen any grave in the cemetery to disinter or remove a body therefrom shall first comply with all pertinent laws of the state and regulations of the State Board of Health and second, a permit from the city clerk upon proper application and payment of the fee required by Section 13.28.090 of this chapter. The application and permit shall set forth the number of the lot, block and addition on which the grave is situated and the name of the person buried, the time of such burial and the place where such body is to be reburied.

B. The reopening of such grave and removal of such body shall be under the supervision of the cemetery sexton who upon completion of the work shall cause a return of the permit to the city clerk.

C. An order of the district court, or the judge thereof in vacation, for the exhumation of the body of a deceased person shall be of sufficient application for a permit hereunder, the cost of such exhumation shall be a claim against the county commissioners as provided by law. (Prior code § 19-207)
